Milei's Government Caught in Legal and Political Bind

Argentina's President Milei faces legal threats over potential malfeasance and the failure of key bills, including labor reform and a fiscal rule, highlighting deep political resistance.

Milei's Government Caught in Legal and Political Bind

President Javier Milei's government is facing significant legal and political challenges. His legal advisors, led by María Ibarzabal Murphy and Santiago Caputo, are obligated to oversee presidential signings but also to analyze potential future scenarios of malfeasance in office. The question arises: can Milei continue to veto university funding, emergency aid for people with disabilities, or allow Congress to run its course without action? Justice always awaits those who serve in public office. To the budgetary crisis, caused by a dispute with the PRO coalition over positions in the National Audit Office, is added the disenchantment from the postponement of parliamentary debate on labor reform. According to libertarian ideologues, this reform aims to dismantle the legal architecture that underpins the Peronist labor model. Peronism, the creator of numerous professional statutes such as the one for journalists, established a separate legal framework for each profession. Now, the Milei administration seeks to end this legal foundation by sending a bill to the Senate that repeals Law 12,908, enacted by Perón's government in December 1946. However, this ambitious reform did not prosper in Congress and will only be discussed again in February. Another key libertarian project is the "Fiscal Rule" bill, which mandates prison terms for officials, legislators, and Central Bank directors in the event of a fiscal deficit. This initiative was also met with disdain, with many empty seats observed during its discussion on the night of December 18th. Many legal experts believe that the President's secretaries, ministers, and even Milei himself could face legal charges for malfeasance in office.
